Terms of Service

1. Acceptance of Terms

The website ("Site") on which these Terms of Service ("Terms") appear is owned and operated by NOWmeds, Inc. DBA NOWmeds ("NOWmeds," "we," "our," or "us"). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use our services.

We may update these Terms at any time by posting the revised version on the Site. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

2. Services Overview

NOWmeds operates an online telehealth platform connecting users with independent, licensed healthcare providers. Our services may include:

  • Information on healthcare and wellness
  • Access to technology-oriented tools for medical treatment
  • Development and gathering of healthcare records
  • Administrative support for scheduling and provider services
  • Telecommunications support for consultations, assessments, and treatment

3. Independent Providers

  • Healthcare providers on the platform are independent contractors
  • NOWmeds does not control medical decisions made by providers
  • No doctor-patient relationship is created between you and NOWmeds
  • The physician-patient relationship exists between you and the healthcare provider delivering care

4. Medical Disclaimer

NOWmeds does not provide medical advice, diagnosis, or treatment recommendations. The decision to follow treatment recommendations rests with you and your provider.

Telehealth services may not be appropriate for all medical conditions. A provider consulting through the platform may not have the benefit of a full physical examination.

5. Eligibility

To use our platform, you must:

  • Be at least 18 years of age, or have parental or guardian consent
  • Provide accurate and complete registration information
  • Use the platform only for lawful purposes
  • Maintain the confidentiality of your account credentials

6. User Responsibilities

When using our platform, you agree to:

  • Provide accurate and truthful health information
  • Follow medical advice provided by your healthcare provider
  • Use the platform only for legitimate medical purposes
  • Not misuse the platform, including attempting unauthorized access
  • Ensure you have an adequate internet connection and compatible device for telehealth consultations

7. Payment and Billing

Certain services may require payment. By using paid services, you agree that:

  • Fees will be disclosed before services are rendered
  • Payments may be processed through third-party payment processors
  • You are responsible for any applicable copayments, deductibles, or uncovered services

Insurance coverage for telehealth services varies and is not guaranteed.

8. Prescription Policy

Healthcare providers may prescribe medications when medically appropriate and permitted by law. However:

  • Not all conditions are eligible for prescription treatment via telehealth
  • Certain medications may not be prescribed via telehealth, including controlled substances in some circumstances
  • Prescription decisions are made solely at the discretion of the licensed healthcare provider

9. Pricing and Fees

The following fees may be associated with services provided by independent healthcare providers on the NOWmeds platform:

  • New Encounter (Routine): $20.00
  • New Encounter (Extended Care): $30.00
  • Follow-up (Routine): $20.00
  • Follow-up (Extended Care): $30.00

NOWmeds currently covers these charges on behalf of patients. Users are not responsible for paying these fees directly at this time.

NOWmeds reserves the right to modify pricing or introduce patient charges in the future with appropriate notice.

10. Privacy and Data Protection

Your use of the platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal and health information.

Where applicable, Protected Health Information (PHI) is handled in accordance with HIPAA and other applicable healthcare privacy laws.

11. Intellectual Property

All content on the platform, including text, graphics, logos, software, and design elements, is the property of NOWmeds or its licensors and is protected by intellectual property laws.

You may not reproduce, distribute, or modify any content without prior written consent.

12. Disclaimer of Warranties

The Site and Services are provided "as is" and without warranties of any kind, either express or implied. We disclaim all express and implied warranties, including the implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.

13. Limitation of Liability

NOWmeds is not liable for outcomes of provider interactions. To the fullest extent permitted by law, NOWmeds shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data or business interruption
  • Technical issues affecting access to the platform

Medical services are provided by independent healthcare providers, and clinical decisions are made solely by those providers.

14. Platform Availability

We strive to keep the platform available and functioning properly, but do not guarantee uninterrupted access. We may suspend or modify services at any time for maintenance, security reasons, or legal and regulatory compliance.

Geographic Availability

NOWmeds connects patients with healthcare providers who are individually licensed in each U.S. state, and ships medications through a partner pharmacy network. We currently ship to 48 U.S. states. We are unable to ship to Arkansas or California at this time. If your shipping address is in a state where our partner pharmacy network is not licensed to ship, or where a provider licensed in that state cannot be matched to your case, you will not be able to complete profile registration or place an order.

NOWmeds verifies the licensure status of its partner pharmacies and providers on a recurring basis. If a pharmacy license becomes lapsed, expired, suspended, or otherwise invalid, affected states will be removed from our supported list and we will pause new subscriptions for patients in those states until coverage is restored.

15. Termination

We reserve the right to suspend or terminate your access to the platform if:

  • You violate these Terms
  • You misuse the services
  • Continued access could create legal or security risks

16. Communication Consent

By using our platform, you consent to your healthcare provider communicating with you through any of the following methods as part of your telehealth evaluation and ongoing care:

  • Video files and HIPAA-compliant audio/video chat services
  • Audio files and phone calls
  • Direct text messaging
  • Email
  • Secure messaging through the NOWmeds platform

Physicians have the ability to send and receive files, messages, and other communications both during the initial medical evaluation and at any time thereafter. You may communicate with your provider through the messaging feature available in your account portal.

By using our platform, you consent to NOWmeds communicating with you regarding account updates, subscription updates, and delivery updates through any of the following methods:

  • Direct text messaging
  • Email

17. Pharmacy Choice

While NOWmeds may utilize a preferred pharmacy network, you have the right to direct your prescription to any licensed pharmacy of your choosing. To request that a prescription be transferred to a different pharmacy, please contact us at help@nowmeds.com with your name, order details, and the pharmacy name, address, and phone number.

18. Emergency and Urgent Care Disclaimer

NOWmeds telehealth services are not intended for emergency or urgent medical conditions. If you are experiencing a medical emergency, call 911 immediately or go to the nearest emergency department. If you have an urgent medical concern that requires immediate attention, please seek care at an urgent care facility or emergency department. Telehealth consultations are not a substitute for in-person emergency care.

19. Alternatives of Care

Telehealth is one option for receiving medical care. You always have the right to seek in-person care with your primary care provider (PCP), a specialist, or another healthcare professional. We encourage you to maintain a relationship with a primary care provider for comprehensive, ongoing health management. If you do not have a PCP, we recommend finding one in your area.

20. No Guarantee of Treatment

There is no guarantee that you will be treated by a NOWmeds-affiliated provider or that you will be issued a prescription. As determined by the provider, care or specific treatments may not be appropriate for every patient. Each provider reserves the right to deny care for potential misuse of services or for any other reason if, in the professional judgment of the provider, the provision of services is not medically or ethically appropriate. The decision of whether a prescription is appropriate is made solely in the professional judgment of the provider.

21. Federal Payor Disclaimer

By using NOWmeds services, you agree that you will not submit a claim for telemedicine services provided through this platform to Medicare, any other federal payor, or any state or private payor. You acknowledge that the services provided through this platform are offered on a direct-pay basis and are not intended to be billed to any third-party insurance program.

22. Indemnification

You agree to indemnify, defend, and hold harmless NOWmeds, MD Integrations, Inc. (mdintegrations.com) ("MDI"), their respective employees, officers, directors, agents, and the independent healthcare providers who contract with MDI from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the platform, your violation of these Terms, or your provision of inaccurate or incomplete information.

23. State Medical Board Complaints

If you have concerns about the care you received from a provider on the NOWmeds platform, you have the right to file a complaint with the medical board in the state where your provider is licensed. Each state maintains its own medical board responsible for licensing and regulating physicians. 24. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts located within that jurisdiction.
